By Basita Michael I regret not being in Sierra Leone during the Bar Association elections. Based on social media reports and colleagues’ accounts, it was a significant victory for Wara Serry Kamal and Augustine Sengbeh Marrah. Despite formidable opposition and the dishonourable actions of the ACC Commissioner, who sought to secure a victory for his candidate by any means necessary, this day demonstrated to the world that Wara Serry Kamal and Augustine Marrah are forces to be reckoned with. It is evident that certain elements within the government fear an independent Bar Association. The disgraceful outcome of the SLBA elections underscores the hijacking of our government by a network of individuals who believe in tyrannical power and employ violence, intimidation, and oppression to maintain control. The actions of the Anti-Corruption Commissioner have led many to question his self-proclaimed achievements and whether he can lead an independent and impartial fight against corruption. As Bob Refell articulated on Facebook, “Francis Ben Kaifala was once a role model for many of us, advocating for democracy and the rule of law. We supported his initiatives like Black Friday in 2018. However, his recent actions have betrayed those ideals. Yesterday, I posted proud photos of being a lawyer. Today, I feel embarrassed to be associated with the legal profession and those who once inspired us.” To my colleagues who share Bob’s sentiments, hold your heads high. Do not let Francis Ben Kaifala’s actions cause you embarrassment. If anyone should feel ashamed, it is the Commissioner and his cohorts. His blatant disregard for the rule of law and the democratic process has revealed him as a pretender and a wannabe tyrant. Social media is now awash with scandalous videos and comments that have turned our country into a laughing stock. As a proud Sierra Leonean and a former President of the Bar Association, I commend the courage you have all shown in condemning these actions. Your voices resonate with honesty, integrity, and decency. Your outrage, along with that of many colleagues and citizens, is essential in dismantling and eradicating corrupt and tyrannical behaviour. However, in our condemnation, I urge all of you to act with empathy and compassion, not necessarily in support of any individual, but in support of a Bar that upholds its integrity.
BIO SLPP GOVERNMENT DESPERATE TO REMOVE AUDITOR GENERAL LARA TAYLOR -PEARCE
By Kabs Kanu This newspaper has learnt from a very reliable source within the government that there is desperation to remove the suspended Auditor General, Mrs. Lara Taylor Pearce by the Sierra Leone People’s Party ( SLPP ) Paopa Government. If this illegal action is taken against the auditor general , it will deepen public ire against President Bio and government and will demonstrate once again the SLPP’s contempt for the principles of transparency and accountability. In November 2021, Mrs. Taylor-Pearce,a national heroine for exposing the economic waste and profligacy of ministries, departments and agencies , as well as the President’s Office in both the APC and SLPP governments , was handed a letter addressed by the chair of the advisory board of the state audit service (ASSL) requesting that the auditor general and her deputy be immediately suspended while the attorney general sets up a tribunal to look into ASSL’s work. It is now learnt that the Tribunal judges are incapable of writing the judgment and the Attorney general ( who is the lawyer to the government) has offered to draft it for them. According to various reports by officials speaking on conditions of anonymity , SLPP Paopa officials are accusing the independent Auditor General that she did not cross – check with President Bio before verifying receipts presented by that office for overseas payments. But this has never been the standard procedure of the auditor general’s office, nor any international audit standards, and even the government knows that it would have watered down the independence and integrity of the audit. Is the SLPP saying that they are covering the corrupt officials in that office who presented those questionable receipts? It is now even clearer this SLPP Government does not play by the rules, laws and constitution and so that is the basis for the efforts being made by the government for her removal by all means possible. If Auditor General Lara Taylor Pearce is removed to add to her already illegal suspension, it will justify everything ever said about the Bio SLPP Government that it is persecuting and punishing the poor woman for performing her duties conscientiously and credibly. And this will add another big blot on the SLPP ‘s commitment to transparent and accountable governance.
ODE TO MY BELOVED BAR ASSOCIATION
By Tommy Somah My Beloved. You guard the noble green, white and blue hue.Corruption and hooliganism are stains that cut throughyour honour, marred to the core. Are you now an emblem of disgrace that leaves us in awe? My Beloved. You once dispensed law and order, neighbours, dazed and amazed, crossed borders, gleaned how you defend human rights. You’ve slandered yourself in darkened daylight. My Beloved. With outstretched hands, you tradeJustice for putrid accolade. You stand in grand halls, draped in robes, secure in your wigs,a camouflage of woeful and shameful deeds. My Beloved.Justice’s scales, once balanced and fair, heavily tip with corruption’s weight and snare.Pungent deals whisper in shadowy rooms, where rigged elections reign, and fairness doomed. My Beloved. You massacre Justice, its plea unheard, drowned by brutal echoes of party cards.Your name archived in shameful realmsthat swim in endless and corrupt streams. My Beloved.Kush gangster is what you have become.Or a deranged puppet of greed. We cry out for Justice, honour and peace, and the day your deceitful acts will cease. There are indeed many things we can read in the inscriptions of the AGM of the Sierra Leone Bar Association. These things debunk the cacophony of lies the APC and SLPP Vampires incessantly peddle: Their fight against corruption. It’s abundantly clear that corruption is ingrained in the country’s DNA. The culprits are mostly those in the higher rung of the state. It’s the truth. The AGM meeting attendees were high-ranking officers, such as Ben Kefala. Accusations of corruption engulfed the meeting. What happened was not a novel incident. It reflects long-standing incidents of election rigging that mock any mention of democracy in the country from when the plague (APC and SLPP) began to the present day. It is staggering to witness the Sierra Leone Bar Association, once a paragon of decorum and integrity, now resembling a gang. The deluge of social media posts on this issue speaks volumes. The APC and SLPP took their battalions to the Bar’s AGM, ready for battle. The saga lent a toxic face to a noble institution that should serve as a beacon of camaraderie in any society. What happened at the AGM mirrors the country’s dismal condition. Unfortunately, denials about the country’s deplorable condition continue unabated. Some denials are so loud they’re worth mentioning. The Critical Mind on the Sankara Radio commendably analysed the Tollgate saga. The Critical Mind told us the Bio administration couldn’t fulfil their promise to review or cancel the Tollgate contract. The Critical Mind said to have done so would tarnish the country’s record and deter prospective investors. I’m afraid I must disagree. The current SLPP government cancelled the $400m Mamamah Airport Chinese-funded project. Wu Peng, the then-Chinese Ambassador to Sierra Leone, told the BBC, ” I don’t think the airport project should affect our future bilateral relations.” Indeed, it hasn’t. The relationship between Sierra Leone and China remains cordial. SLPP said President Bio saw no need for the Mamamah airport and was “considering a bridge from the capital to Lungi airport.” The cancellation of the Mamamah airport did not deter the Turkish company from signing the contract for the current new airport. It’s logical to assume that if the SLPP government had cancelled or reviewed the Tollgate contract, prospective investors would have been alerted that one must have clean hands to do business in Sierra Leone. Also, the SLPP allegedly cancelled or suspended some mining projects, including the Tonkolili and Marampa iron ore mines. I guess the Critical Mind is unaware of these. One can suggest that Tollgate was APC’s cash cow. The SLPP should have, as they promised, cancelled or reviewed the Tollgate deal in the national interest. They did not. As it stands, the agreement is inimical to the nation’s genuine interest. The government discovered that the Tollgate has juicy bits that are too sweet to cancel. Critical Mind, can we agree on this? Good day Mr Abubakar Kamara. Mr Abubakar Kamara (APC) asked: “Are politicians from the diaspora more liabilities to Sierra Leone or Blessings?” Mr Abubakar wants diaspora politicians to use their “fat salaries” to cure Sierra Leone’s problems, a problem Jesus Christ himself cannot solve. Mr Kamara, diaspora people cannot and should not heal Sierra Leone’s sickness. Do you know your EBK is allegedly one of the richest in Africa? Are you aware of the unexplained wealth of past and present government ministers whose ostentatious mansions obscure those of the ministers in the diaspora? Are you aware that some of the ruling elites, by looting the country’s resources, allegedly have underworld foreign bank accounts, leaving the nation poverty-stricken? Do you know that billions of dollars illegally disappear from government coffers without investigation? Do you know the diaspora remits approximately 280 million dollars into the country annually? While those in the diaspora remit into the country, some of its elites loot it into foreign banks. If we’re serious about healing the country’s sickness, we should confront it honestly and holistically. We must stop patronising the culprits. Putin couldn’t have summed it up better when he said the African soil could feed Europe, America and Asia, but their problem is just one: THEIR LEADERS. If Putin had seen the fact, why are we still in denial and outwardly blaming everyone instead of the Vampires? Sierra Leone’s nemesis is itself. Finally, Sierra Leone spoke clearly by voting against Ernest Bai Koroma’s corrupt APC government. Yet, we focus more on the past than confronting the chaotic present. The focus should now be on the current regime. Criticising the current government’s malpractices is not the same as opposing the government. We must take our cue from Singapore. We must stop blaming and begging others. The medical treatment to heal Sierra Leone is in Sierra Leone.
Bio urges cabinet ministers to deliver for all citizens of Sierra Leone
President Julius Maada Bio has urged his cabinet ministers and their deputies to avoid distraction and focus on delivering on the campaign promises he made during the 2023 general elections. He was addressing his ministers and their deputies at the Ministerial Retreat in Bo city, Southern Sierra Leone, where he also said they should not leave things undone on their desk for more than one hour. “There should be collaboration and coordination between all of you. You don’t have to be friends but you can consult each other when the need arises. Collaboration should be both horizontal and vertical at all times,” he said. He said they owed the citizens of Sierra Leone and it was incumbent on all of them to deliver so as to make life better for every Sierra Leonean. “We are here to recalibrate and set our own targets which aimed at delivering on our campaign promises. We were called to serve and therefore we are servants,” he stated. President Bio noted that as the team leader, he was urging them to have a shared understanding of what it takes to deliver for the people of Sierra Leone. “We have not been truly inspiring as we ought to be. We have to be optimal in our delivering. I put this team together because I cannot do it alone. The expectations of our people are high and we should work as a team to meet those expectations,” he stated. He said he was made to understand that some team members were working in silos and that would not improve team performance and effective service delivery. “We have to let the people know what we are doing. If you don’t create your own version of the story, others will tell it in a very wrong way. There are many platforms to spread information these days and we should leverage on those platforms,” he said. He stated that they should be working together to cushioning the global economic constraints of the people, adding that there was a social contract between them and the citizens of Sierra Leone. “If we are in doubt, we should look at best practices elsewhere or consult our colleagues to find a lasting solution. No Ministry, Department and Agency (MDA) can work alone, we should always collaborate,” he told his audience who were mainly ministers and their deputies. He said he wanted his cabinet ministers to set the Sierra Leone People’s Party (SLPP) as one that can deliver on its promises, noting that he saw his cabinet as a great team if only they could work together. Chief Minister, Dr. David Moinina Sengeh, said the Ministerial Retreat was in Bo upon the request of President Bio who wanted to bring his executive government closer to the people. “We will also hold our usual cabinet meeting here in Bo city on Wednesday 22nd May 2024. This is a new development as we will take critical government decisions in Bo,” he said. Secretary to Cabinet and Head of Civil Service, John Sumaila, recalled that since 2018, they have held three cabinet retreats, adding that the engagement in Bo city would deepen their understanding and reinforcing their continued determination for service delivery. “There is a need for teamwork between ministers and their deputies. There is also a need to establish an effective service delivery system so as to enhance high level of productivity and performance,” he noted.
“ illegal Bar association executive “
By Feima Sesay Wara Serry Kamal and Augustine Sorie -Sengbe Marrah , the two presedential candidates together with some Aggrieved Members of the Sierra Leone Bar Association have in a Joint statement said that the just announced executive members of the Bar Association is illegal and an affront to democracy and rule of law . Both candidates further condemned the event at their AGM in Kenema. They spoke to journalists at press conference held at the New Brookfields Hotel in Freetown . This came following allegations of irregularities, violence and forceful election of new leadership within the Sierra Leone Bar Association. The Joint press statement by Augustine S. Marrah and Wara Serry-Kamal Condemned the entire events at the Annual General Meeting of the Sierra Leone Bar Association in Kenema on 18th May2024. According to them, the events at the Annual General Meeting (“AGM”) of the Sierra Leone Bar Association held in Kenema represent a grave assault on the principles of democracy, transparency, and integrity that the association is founded upon. The actions and inactions of the Board of Directors at this AGM, which have led to a declaration of a purported executive that was not duly elected, they said are not only illegal but also deeply troubling. Before the date of the AGM, they said they made concerted efforts to enhance the integrity, transparency, and accountability of the electoral process.” Our actions included the following:1. Court Applications: – Solicitors for Julian Cole Esq., Wara Serry-Kamal, and Joy Precious Bayoh filed applications in court aimed at ensuring greater participation of members. These applications sought voting by proxy, early publication and verification of the voters list, among other things” The courts they said refused to grant these applications.Secondly, security concerns they said was raised by Wara Serry-Kamal, through two letters addressed to the Inspector General of Police, requesting a meeting with the Sierra Leone Police to discuss and address security concerns ahead of the conference but her requests for a meeting were not granted.Thirdly Proposed Meetings by Augustine S. Marrah and Wara Serry-Kamal, through letters addressed to the outgoing President of the Bar, proposing a meeting with the directors of the association. The purpose was to discuss and outline a clear pathway for the electoral process. The President they said declined to meet with them. These events confirm that what occurred at the AGM in Kenema was enabled by the Association’s Directors, and the position of the Sierra Leone Police and the Court did not help the situation.”It is with great disappointment that we address the series of undemocratic man overs orchestrated by the Association’s directors and their enablers in Kenema. These include the blatant disregard for the electoral process and the disenfranchisement of members, which are clear violations of the Memorandum and Articles of Association of the Sierra Leone Bar Association, the Companies Act 2009 (as amended) and ethical principles of decency and integrity” Manipulation of Voter List according to the. was evident from the outset that the integrity of the voter list was compromised. Members who had duly paid their dues found their names omitted from the list, an issue that was raised by some members and yet was not addressed by the directors. ”Unlawful Agenda Changes, The amendment of the agenda to commence voting prematurely at exactly 12pm, when in fact the time slated for registration and arrival of members was 12 to 1pm, was a calculated move to disenfranchise colleagues who were traveling from Bo & Freetown and whose movement had been strangely blocked by a truck on the Bo-Kenema highway. Imposition of a Returning Officer and the purported appointment of Francis Kaifala, the Commissioner of the Anti-Corruption immission, as Returning Officer, despite objection to his nomination on the grounds of conflict of interest; the omission to put the other nomination of Julius ye Cuffie including Mr. Kaifala’s to a vote by the members; and the retusal to allow the usual practice of appointing three senior members of the Bar present in the hall to assist the Returning Officer, which would have ensured a fair process they said is unacceptable. The acts of Francis Kaifala, the ACC boss, purportedly acting as the Electoral Commissioner they said undermine the very democratic processes they seek to uphold. Sham Electoral Process: The purported elections presided over by Francis Ben Kaifala was conducted without recourse to any verified voter list; in a hall shut down by security personnel on the instructions of Mr. Kaifala, after security personnel had dispersed with pepper-spray and/or teargas a majority of the members who were present. That only a handful”of members (including other unidentified persons) who were in support of Tuma Jabbi and who mostly wore blue wrist bands were allowed to vote. Other fully paid-up members were denied ballot papers while those with the blue wrist bands received multiple ballots. The handful of voters for Tuma Jabbi, under the watchful eyes of Francis Kaifala, were able to mysteriously generate among them, the total of 560 votes for Tuma Jabbi in the purported election for president of the Bar Association. ”In view of the events narrated above which are an affront to the values of integrity, accountability, and democracy” we take the following positions:1. The executive purportedly selected at the AGM in Kenema does not represent the will of paid-up members of the Sierra Leone Bar Association. We do not recognize them as duly elected.2. We shall explore all legal means to ensure that an election of directors of the Association consistent with democratic standards is held as soon as possible.3. We shall also explore all accountability measures against all those who were complicit in the sham electoral processremain steadfast in the face of these challenges. We urge all members of the Sierra Leone Bar Association to join us in this call for justice and toTogether, we can reclaim our Bar Association and its voice; uphold the standards of democracy and fairness that we all cherish.
